Auto Recovery & Lien Enforcement
The Default Services Practice Group attorneys have dealt with nearly every default servicing, lien enforcement, bankruptcy and creditors’ rights issue imaginable and their practical and technical knowledge of the law and practice norms is virtually unparalleled.
For 40 years, HWA’s seasoned attorneys have prosecuted sequestration (replevin), receivership, collection and deficiency lawsuits (including post-judgment) in state and federal courts in situations where self -help cannot be effected because the borrower is hiding the vehicle, a mechanic or storage facility is holding the vehicle subject to an alleged lien for “overstated” charges and/or the vehicle has been seized or impounded by the Texas border patrol, the state or federal district attorney in connection with a criminal action and/or other regulatory authorities. HWA attorneys regularly appear in federal bankruptcy court to protect and/or enforce the security interests of their clients in motor vehicles and have good working relationships with the judiciary, the Chapter 7 and 13 bankruptcy trustees and debtor’s counsel. These relationships are often a critical factor in resolving disputed matters.
